Sorry to hear about your job loss. Never a good thing and especially now.
I have wondered myself if there is recourse specific to having cancer that might prevent an employer from any layoff/fire action. Good luck and I hope you win.

We are protected under ADA, and they should try to accommodate, but this employer or boss is ignorant or just doesn't give a dam! For being HR she has a pretty sorry attitude!0 -

Just what you need is another battle on this front! I remember you had a hard time with them while you were going through treatments and they were giving you a hard time about not being available for phone interviews or something like that. Sounds to me like they were setting themselves up for this even back then. Hope you get resolution satisfactory to you!

Get her Nana! Maybe this will work out to be a positive for you, if you were wrongfully terminated related to your medical condition, when it all comes out you would be due back pay, punitive damages and so on, and have some time off with pay without having to work during your treatments.

That is terrible. Hopefully you can get some recourse from them. Is there any chance of you talking to someone higher in the company to possibly get your job back. Sounds like you have gone to great lengths to please them through your whole journey. Keep us posted.

I had to fight for my job back last year, I went through the EEOC process, he is a good attorney, he is located in Dallas, not sure where you live, but I was living in Phoenix at the time and he still represented me. A bit pricy but he worked with me so that I could make payments. let me know if you want his name...

Be thankful you do not live in NJ. The courts favor business here. My employer laid me off September 2, 2009, mid-treatment. How heartless was that? Since they closed the NJ offices, I had no case, everyone was let go and I was one of the last. At least I saw it coming, but was hoping for something more like December.

It is terribly sad that employers think they can get away with these types of things and care more about their profits than they care about fellow human beings.
The ACLU is a fantastic organization and usually scare the heck out of anyone they go up against. You may have to be a pest to get representation due to the large number of cases they handle, but when they bark - people listen - because no one wants to get bitten by the ACLU.0 -

Make sure that you ask for the cobra supplement payment that Federal Government approved during the "meltdown". Your empoyer may not tell you about it and unless you know to ask they may try and slip it past you as the emplyer still has to pay the full premium and then get a tax credit. this COBRA supplement pays for 80% of the cobra paymen. My neighbor had this happen and luckly she said something to me and I told her about and it took her CObra payment from 600 a month down to 200.0
