When is one considered disabled by colorectal cancer. Of course never would I'd be available to serve on a jury because of going to the bathroom as many times a day as much as 15-20 times a day, but haven't worked in about 8 years. Just wondering your thoughts on this.

Hugs! Kim

    Kim –

Now that I have been resected again, and have an Ileo,
plus ½ of my small intestines, I have what is known as the
    dreaded “short bowel syndrome”.

I had been released from jury duty prior to this last surgical
debacle, but this has sealed the matter permanently.

Any “stage four” is apparently automatically excused.
I’m not sure if they figure we’re going to die before the
court rules, or if maybe we don’t care who we take
with us…. But they don’t seem to want us making life
    decisions for other people.

    Smart move, probably…. I don’t want some guy that’s
facing death within the month, deciding if I should fry in
the chair for calling my neighbor a hoe.

    I hope that helps?

    Stay sane, and healthy,

    John

the worst they could do is deny your claim. I first applied when I was stage 3, they denied me, I appealed, they denied me, then the cancer came back Stage 4, I reapplied they approved me. But I made the mistake of going back to work, as you know I was supposed to die and didnt, so now SSA is saying I owe them to the sum of 43 thousand dollars, have to get an attorney or file bankruptcy. But that is my story, just another stressor in my life. I believe if you are not able to work either due to going through treatment or from after effects from going through treatment, you should get approved. Now remember most get denied the first go around, just appeal, cant hurt, like I said the worst they could do is say no, just dont do what I did and go back to work....its messy now...

    Good Luck

Stage IV is automatic. Anything else they look at very closely. Since you haven't worked in 8 years, they will look at that also and it might work against you. What I mean is that their thinking might be that you haven't been working and now you are claiming you can't work. If you can, ask a social security attorney and get their take on it before applying but not having worked in 8 years may work against you in claiming disability.

Best wishes and good luck - Tina

    Hi Gracie!!! It's your "Friend-in Penn" !!
Just happened to be on the site today as it's been awhile and saw this post....

An update on my SSD situation...I did alot of research and phone calls and after being denied, I finally was approved just a few weeks ago...the SSD doesn't actually begin until September...

Meanwhle I was fortunate to have a disability plan where I worked and got approved for it in late Winter. With the SSD, I could not have an earned income, (this was the denial), but fortunatley, the employer-disability does not count as income...So, long story short, I had to really hash this thing out...So after 25 years with the State, I retired...(it was time, after 31 chemos, and 28 radiations). I recieve long term disability now, and will recieve SSD in September...

    Hope you're doing well!

    applying is easy
You can go online to apply for SSD, but I went to the local office to do so...hoping that the personal visit would improve the results or make it go quicker. I don't know if I had filled out the forms online if my case would have been accelerated for a decision as it was...the case worker who filled out my forms said I would have an answer very soon...and I did get answered in less than a month...approved! There is a five month wait with no benefits that begins with the start-date of your claim...my start date was at cancer dx, though I did try to have it start previously, from when I had colon surgery since I couldn't work after that.

The main qualification seems to be whether you can do the work you have been trained for...and whether you could do it full time. I don't think it is so much a matter of if you have worked, rather whether you CAN work now.

It is good to know that if you have children at home under 18 and in school, they can get benefits too. My daughter will receive $500 monthly based upon my disability :)

Apply now...the worst thing they can do is say no.

    iHi Janine:
I just based my answer on a past member of our board, Donna, who has since passed away. Donna had not worked for several years, she was home raising 4 children, and with her Stage IV diagnosis and a hubby who was laid off, she tried to get social security disability. She was denied since she had not worked for an extended period of time and was not disabled from working until cancer struck.

Her and I pm'd back and forth on this subject trying to find a way around her denial with no success. If memory serves she did not seek the services of a social security attorney, she just could not afford it.

I felt so sorry for her, 6 people living on unemployment, it was pretty tough over at her house. The welfare system was of little help since they did have income, big deal, it was unemployment. Talk about frustration.

    Take care - Tina
