"Special dipensation" on disability ssdi benefits already approved

My husband, stage four with lots of mets, was approved back in November 2009, for ssdi but we got several letters stating there is a "six month waiting period"., so his first check does not start until May 2010. I keep reading about this "special dispensation" and have called ssi and they still claim "there are no exceptions to the rule". We live in Mass., are these rules different by state to state, how can I speed up these benefits, we have had no income since last October, I am using a trust fund account that is in my name and my daughters. I cannot wait until May??????

    SORRY BUT THERE IS A 5 MONTH WAITING PERIOD
    I live in Oklahoma and because my husband was diagnosed in April 09 and we applied in November we had already did our waiting time so that is why we got ours through so fast. You won't be able to get your first one until after 5 months If I can help let me know

    Its call compasstionate allowence
    Hi Linda

    EC is listed under compassionate allowence in ssd. I really do not know of the waiting period and Lori knows more about that, but I would get an attny to look into it. Most will give you a consultation for free. Thats how I learned about it also go online to socialsecurity.gov and look it up there are about 50 diseases listed.

    It doesn't hurt to apply, or to ask an attny about the waiting time.

    I just get angry about the entire thing if they do make you wait 5 months then that really sucks. Not to be cruel but your loved one could be gone by then. Then what!

    I work for an Atty that does Disability and there is a 5 month waiting period regardless. I am still trying to get Steves and he passed away. I would only get his back pay. We applied in Nov. 2009..claimed onset date of disability as Feb. 2009..if I get the back pay I would only get July 2009-Nov2009. Maybe prorated Decemberif I am luck, but you usually have to be alive the entire month..I see it everyday and its stupid, but thats how it wirks You would think it would be automatic, but it's not.

    I am sorry that you have to wait for what belongs to you. This just is'nt fair. We applied and weren't approved due to some other b.s stupid rule.

    I think that I am going to call my congressmens office and discuss this with someone I know there if the President wants to change things and help people he should start by giving people the money that by law is rightfully theres.

    In PA the to get alot of the people off of welfare they had them sign up for ssd or ssi. So now people that truely need it have to wait.

    When I was working as a medical assistant at a pediatric office Moms couldn't wait to get there kid diagnosed as ADD or ADHD or some other diagnosis that they found out that you could
    get ssi or ssd for the child.

    That was the last job I worked and the reason for my cervical spine injuries a kid was fooling around and tripped me.

    Any way sorry about the tanget, It just makes me angry.

    I still have not been approved. That has yet to be seen. They told me they were making a decision, but wouldnt't tell me what that decision was. I know how you feel. I deal with people all day who are trying to get disability. I did not apply for the disability until November of 09. Steve was diagnosed in February 09. I called them when we found out his cancer was back, and I called again after he died. You should have a contact person at Social Security that you can talk to about this. Thier rule is that your disability has to last more than 12 months or result in death, before they make an automatic favorable decison. Now the reason that I didnt apply before November is that SSA also considers the cancer "cured" if there has been surgery to remove the cancer. So they won't rule automatically. It's a crazy system. I have a cliet with a disease that he WILL die from...one day, they cant tell him when, and they wont approve his in a fast manner. It frustrating, but just like dealing with Dr.'s, sometime you have to call and be very persistant.
